Studio 191 – GENERAL TERMS AND CONDITIONS

Article 1 – Definitions 

Studio 191 de Pijp B.V. and Studio 191 West B.V., founded and located in Amsterdam at Lutmastraat 191B, 1074TV, and Jan Her numbers 69832021 and 69832013 respectively, operating under the trade names Studio 191 de Pijp, Studio 191 West and Studio 191 Oost and hereinafter referred to as “Studio 191.” 

  • Guest(s): Any paying or non-paying participant of a class, workshop, training, other event hosted at or given by Studio 191 arriving directly through Studio 191 or via a third party (e.g. OneFit or Classpass). By entering the Studio or attending a Class, any Guest is considered to be entered into a Guest Agreement with Studio 191.
  • Guest Conditions: These general terms and conditions, which are published onanzenstraat 54h, 1053ST, respectively. Registered with the Chamber of Commerce und the Studio 191 Website and will be provided upon the first request from a Guest.
  • Credit: The credit or balance purchased by a Guest via the Website, App or on-site in the Studio for any class cards or memberships to book and/or attend a Class at a Studio 191 Studio within the specified period.
  • Class: Any (individual or group) class, workshop, training or other event given by or hosted at a Studio 191 Studio.
  • Personal Data: All data provided by a Guest directly to Studio 191.
  • Studio: Any studio operated by Studio 191, as shown on the Website.
  • Practice Room: Any location or room where a Class takes place in Studio.
  • Participation Period: The period of time from the purchase of Credit, within which a Guest has the right to participate in an appropriate class, workshop, training or other event given by or hosted at a Studio 191 Studio.
  • Website: The website of Studio 191

Article 2 – House Rules

2.1 It is the responsibility of each Guest to familiarise themselves with these Guest Conditions of Studio 191.

2.2 Studio 191 reserves the right to limit the total number of registered Guests, as well as change the opening hours, Class times, number of classes, and pricing.

2.3 Studio 191 also reserves the right to refuse Guests in case of misuse of the subscription system or Studio 191 facilities or in the event of inappropriate behaviour.

2.4 Wearing clean sportswear is mandatory. Wearing shoes in any practice room is prohibited.

2.5 The use of a towel for every activity is mandatory.

2.6 Every Studio 191 location is smoke-free.  Smoking is prohibited at all Studio 191 locations.

2.7 Consuming self-brought drinks and/or food at Studio 191 is prohibited, except for the use of bottles or sealable, plastic bottles with water.

2.8 Studio 191 reserves the right to close the entire day or part of the day on recognised holidays or during renovation.

2.9 Children under 16 years of age are not allowed at Studio 191, except for children under the supervision of their parents or with explicit consent from Studio 191 personnel. Leaving children waiting in when the parent(s) attends a Class is strictly prohibited. Children under the age of 16 are not permitted to attend classes at Studio 191. Any injury to children or damage to children’s property due to unauthorised access to the Studio is at the individual’s own risk.

2.10 Pets are not allowed at Studio 191.

Article 3 – Applicability 

3.1 These Guest Conditions apply to all legal relationships between Studio 191 and a Guest who has purchased Credit and/or participates in a Class offered and/or provided by Studio 191 and/or Credit purchased by a Guest.

3.2 By purchasing Credit or participating in a Class, the Guest agrees to these Guest Conditions.

3.3 All provisions in these Guest Conditions are also drawn up for the benefit of all directors of Studio 191 and all persons employed by or contracted by Studio 191.

3.4 Deviations from these Guest Conditions are only valid if expressly agreed upon in writing by Studio 191 directors.

3.5 Studio 191 can amend these Guest Conditions at any time. The latest version is always the valid version and is available on the Website. A copy of the Guest Conditions will be provided upon request.

Article 4 – Guests

4.1 Guests will receive a login name and password for the Studio 191 registration system, operated by BSPORT, during or immediately after registration. Guests are responsible for maintaining the security and privacy of their own username and password associated with their personal account.

4.2 The completed Guest Conditions constitute the full representation of the rights and obligations of Studio 191 and the Guest and supersede all prior written and oral announcements, agreements, and other correspondence.

4.3 The Guest ensures that all data – which Studio 191 indicates as desirable or which the Guest should reasonably understand as necessary for the performance of the Guest Agreement – are provided to Studio 191 in a timely manner.

4.4 An agreement between Studio 191 and a Guest consists of one or more Credit(s), which entitle(s) the Guest to participate in a (limited number of) Class(es) during the Participation Period. Therefore, Credits have a limited validity. The individual validity is indicated in the Guest’s account on the Website. Once a Credit and/or a collection of Credits has expired or has been used up, a Guest cannot sign up for a Class using these Credits.

4.5 In case of severe injuries, prolonged illness, pregnancy, or prolonged stay abroad, the validity of Credit or a collection of Credits may be suspended with the written consent of Studio 191. Studio 191 has the right to request evidence before granting a request for suspension.

4.6 Credit(s) and/or a collection of Credits automatically expire. Credit(s) and/or a collection of Credits will not be automatically extended.

4.7 If the Guest decides to purchase a new/additional Membership with Studio 191, the terms of these Guest Conditions will continue to apply in full, unless expressly agreed otherwise in writing.

Article 5 – Prices & Payment

5.1 The current prices for one Credit (Class Cards), a collection of Credits, or a Membership are stated on the Website. The latest prices are always valid and available on the Website. Price increases do not affect already purchased and paid Credits or collection of Credits.

5.2 Only Unwashed, unworn, and labelled items can be returned within 14 days of purchase for a refund or Studio 191 store credit only. 

5.3 Receipt or proof of purchase must accompany the return to process the refund. All sale items and accessories, including, but not limited to grip socks and water bottles, are final sale unless stated otherwise.

5.4 Unless otherwise agreed, payments must be made via the online payment system or on-site at Studio 191. Credits, Memberships, collections of Credits and retail items must be paid in full in advance. 

5.5 Payments made by a Guest will not be refunded unless a valid revocation is made by the Guest.

5.6 Studio 191 reserves the right to index and change its prices and rates.

5.7 If the facilities of Studio 191 cannot be fully used due to circumstances beyond Studio 191’s control, the fees payable by the Guest for using the facilities of Studio 191 will not be refunded.

5.8 No rights can be derived from promotions or special offers before or after their validity period.

5.9 A member shall not redeem a class for cash, and a class cannot be transferred to another person, unless written permission is given by Studio 191.

5.10 A member’s payment method will be charged for the order when Credits are purchased, not when Classes are booked. 

5.11 All introductory offers, promotions, and discount codes are for one-time use only per individual unless explicitly indicated otherwise.

5.12 It is a member’s individual responsibility to be aware of any changes in price or expiration of Credits or Classes after the introductory offers, promotions, discounted credits, or memberships end.

Article 6 – Bookings, Cancellations and Reservation Changes

6.1 In order to make a booking, a guest must first own a class card, or a membership. To buy a class card, multiple class cards, or a membership online, a guest can either sign up on the Website or Application using a personal email and creating a password or, if already registered, log in to purchase credits or memberships and make bookings.

6.2 Classes/credits have an expiration date stated on the pricing page on the Website and Application.  Future prices are subject to change.

6.3 A Guest must sign up in advance for a Class through the designated online registration system, or on site at the Studio. Without an active booking of the specifically desired class, a Guest has no right to participate in a Class.

Come to the correct location

6.4 Please pay close attention and choose the intended Studio when booking. Booking at one studio and showing up at another studio is not allowed and is considered an invalid booking. If a Guest shows up at a studio, for which a booking is not valid, the Guest does not have the right to attend a class at this location.

6.5 If a member wishes to simply cancel a booking for a class, they may do so up until 12 hours prior to the start of the applicable class. This applies to all classes.  If a booking is cancelled before this time, the guest’s unused credit will be returned to the guest’s account to be used at a future date.

On time

6.6 Please be on time, we can not let you join a class after the class has started. Please note that arriving late will lead to a loss of your Credit.  Arriving after admission to a class has ended, does not entitle a guest to a refund or to move their booking to another class.

First Time

6.7 Joining Studio 191 for the first time? it is advised to arrive 10 minutes prior to the start time of the booked class – this will allow a full introduction to the studio and any relevant information for the scheduled Class.

6.8 Studio 191 is entitled to adjust the class schedule and/or locations at any time without stating reasons. The latest schedules and locations are always valid and available on the Website.

6.9 Studio 191 has the right to cancel a Class if there is insufficient sign-up until the start of a Class. In that case, a Credit charged to the Guest will be returned to their account.

6.10 Extraordinary circumstances always constitute force majeure for Studio 191 and release Studio 191 from its obligations. In the event of continuing force majeure, Studio 191 is released from its obligation to fulfil the agreement.

6.11 If a Guest causes such inconvenience or nuisance that the proper execution of a Class is hindered in any way, Studio 191 may exclude them from the Class. All resulting costs will be borne by the Guest.

Article 7 – Credits & Memberships

7.1 For each collection of Credits, it is described how many times the Classes can be attended during the Participation Period. Unused Classes during the Term will expire automatically.

7.2 One Credit entitles the Guest to participate in one corresponding class Class. Reformer class credits are only valid for Reformer classes.

7.3 For other reasons (e.g. travel), the Member is allowed to temporarily freeze the active series for a maximum of 4 (four) one-week periods within 1 year/52 weeks. During a suspension, it’s not possible to book classes.  For a membership freeze, email accounts@studio191.nl.

7.4 The Member acknowledges that they are entering into the membership for the agreed term as stated on the Website and the Application, which begins on the date of the purchase of the first 1 (one) month of the membership.

7.5 Studio 191 offers 5 (FIVE) memberships. All of which have a minimum duration of 2 months

  • Everything 12 Membership – 
    • This membership INCLUDES Reformer classes and allows for booking classes at any time and any class style and at any Studio 191 or The Cosmos location across Amsterdam. 
    • Recurring monthly price = €210 per month.
    • Unused credits will roll over for 1 month. (e.g. if all credits are not used in March, the leftover credits will roll over and can be used in April, but credits from March will not roll over until May). 
    • Studio 191 & The Cosmos has a 12 hour cancellation policy; All classes must be cancelled online via your Bsport account more than 12 hours prior to the class starting time.
  • RiseTo5 Membership- 
    • This membership is for our off peak classes (not including Reformer classes) with a start time between opening until 17:00, 7 days per week.
    • Recurring monthly price = €64.00 (Sixty Four) per month. 
    • Unused credits will roll over for 1 month. (e.g. if all credits are not used in March, the leftover credits will roll over and can be used in April, but credits from March will not roll over until May). 
    • Studio 191 & The Cosmos has a 12 hour cancellation policy; All classes must be cancelled online via your Bsport account more than 12 hours prior to the class starting time.
  • Reformer10 – 
    • Reformer10 Members have full access to 10 monthly reformer classes (currently in our West studio location but coming to de Pijp in Spring 2025) per month
    • Recurring monthly price = €190.00 per month. 
    • Unused credits will roll over for 1 month. Unused credits will roll over for 1 month. (e.g. if all credits are not used in March, the leftover credits will roll over and can be used in April, but credits from March will not roll over until May). 
    • Studio 191 & The Cosmos has a 12 hour cancellation policy; All classes must be cancelled online via your Bsport account more than 12 hours prior to the class starting time.
  • Monthly8 Membership
    • This is for any class (not including Reformer Classes) at any time of the day, at any Studio 191 or The Cosmos location across Amsterdam.  
    • Each Member will receive 8 Credits per month. Unused credits will roll over for 1 month. 
    • Recurring monthly price = €80.00 per month.
    • Unused credits will roll over for 1 month. (e.g. if all credits are not used in March, the leftover credits will roll over and can be used in April, but credits from March will not roll over until May). 
    • Studio 191 & The Cosmos has a 12 hour cancellation policy; All classes must be cancelled online via your Bsport account more than 12 hours prior to the class starting time.
  • Oost Unlimited Off Peak Membership
    • This Membership is valid at Studio 191 Oost ONLY.  This membership cannot be redeemed at any other Studio 191 or The Cosmos location.
    • This Membership has a minimum commitment of 2 months.  After the first 2 months, it will renew every month until cancelled within cancellation conditions. 
    • Maximum of 1 booking per day.  
    • This membership does not include the “bring a guest” option. 
    • Studio 191 & The Cosmos has a 12 hour cancellation policy; All classes must be cancelled online via your Bsport account more than 12 hours prior to the class starting time. 
    • Please note that our non attendance/late cancellation policy applies to this membership: There will be a €5 fine for no-show or late cancellation.

7.6 All prices stated are inclusive of VAT. Studio 191 is authorised to adjust its rates at any time in the event of any changes to the amount of VAT.

7.7 The Member is obligated to cover any outstanding payments before the termination date. 

Not complying with this regulation will result in 2 (two) official warnings sent to the Member in writing, followed by engaging in the services of an external collection agency in order to obtain any outstanding payments. Studio 191 is authorised to decline access to its facilities and/or suspend the membership for the Member not complying with this regulation until all outstanding payments are covered.

7.8 The membership is strictly personal and can only be transferred with the permission of Studio 191. Such request has to be done in writing by the Member holding the membership to the official email address of Studio 191: accounts@Studio 191.nl

7.9 Studio 191 reserves the right to request Members for identification at any point while on the premises.

Membership fees

7.10 The membership fee must be paid by the Member using SEPA Direct Debit or with a valid Credit Card or via a pay-link issued to the Member’s email address, for the entire term of the membership in advance, on a monthly basis, or, if required, for the initial or remaining term of the contract (or an extension thereof). 

7.11 Studio 191 reserves the right to collect overdue payments.

7.12 If a SEPA Direct Debit or Credit Card payment is rejected, Studio 191 will send an automatic reminder in writing to the Member requesting to cover the outstanding payment as soon as possible.. Should the payment remain incomplete, 2 (two) official warnings will be issued in writing to The Member, followed by opening a case within an external collection agency to obtain the outstanding payment.

7.13 If Studio 191 is compelled to engage the services of a collection agency in order to collect payment from the Member, the latter will also be required to pay administrative charges and any extrajudicial collection costs in the amount in accordance with the scale of collection costs. The Member will not be authorised to use the services and facilities provided by Studio 191 until such time as their overdue debt has been settled in accordance with the arrangements made with the collection agency.

Termination

7.14 Members can cancel their membership with a 1 month notice at the end of the commitment period. The 1 month notice starts after the end of the last payment term. The membership must be active during the 1 month cancellation period.

7.15 This cancellation must be made in writing by sending a request to accounts@studio191.nl and confirmed by the member after receiving the formal ending date of the membership as stated by Studio 191. Verbally requesting to terminate the membership at the Studio accepted as valid cancellation.

Article 8 – Account Termination

8.1 The Guest can always delete their account via the Website or Mobile App.  Note: Deleting your account, does not cancel your membership – to cancel a membership a member must email guests@studio191.nl.

8.2 In the case of prolonged illness, injury, and/or pregnancy of the Guest, the Guest Account can be temporarily suspended or terminated after consultation and submission of a written medical certificate.

8.3 Studio 191 has the right to terminate the Guest Account with immediate effect if:

  • The Guest engages in unacceptable behaviour according to Studio 191’s judgement.
  • The Guest systematically violated Studio 191’s rules.
  • A third party uses the Guest’s Guest card due to negligence or with the Guest’s knowledge.

8.4 In the case of national restrictions or special government measures prohibiting the operation of gyms and Studio 191 thereof, a collective suspension on all active memberships may be imposed for an indefinite duration, or until the national restrictions or government measures change and regular services can be provided again. The scope, extent, and duration of the special collective membership suspension are at the sole discretion of Studio 191, and in such a circumstance, members receive a digital notice via email issued by Studio 191 providing information about the event, (expected) duration, and any other important information.

8.5 In the case of national restrictions or special government measures limiting, but not prohibiting, the operation of gyms and Studio 191 thereof, allowing Studio 191 to provide (limited) services, Studio 191 reserves the right to continue keeping memberships active according to the regulations provided in these terms and conditions. 

8.6 The membership can never be suspended retroactively.

8.7 The Member’s payment obligation will be deferred to the actual term of the suspension. The termination date of the membership contract will be extended by the term of the actual suspension. This also applies in extraordinary circumstances, such as national restrictions or emergency government measures.

Article 9 – Risk & Liability

9.1 The use of Studio 191 studios for Classes, training or activities of any kind at Studio 191 is entirely at the Guest’s own risk and responsibility.

9.2 The Guest is obliged to inform Studio 191, before their class about their physical condition, such as injuries, illnesses, and/or other physical conditions, and provide information that the Guest reasonably understands is necessary for exercising exercises. The Guest is solely responsible for providing this information.

9.3 Both Studio 191 and its employees are not liable for material and/or immaterial damage resulting from an accident or injuries of the Guest and/or third parties.

9.4 Studio 191 and its employees accept no liability for damage, loss, or theft of the Guest’s or third party’s property.

9.5 The Guest is liable for damage caused to Studio 191’s property if such damage results from negligence and/or fault of the Guest.

9.6 The exclusions and limitations of liability as stated in this article are also stipulated for the benefit of Studio 191’s subordinates and any other individuals whose assistance Studio 191 uses in the execution of the Guest Agreement.

Valuables and Personal Property

9.7 Guests acknowledge that bringing valuables into and unto the Studio is done so at their own risk and that Studio 191 shall not be liable for the loss of, theft of, or damage to personal property, including items left in lockers, bathrooms, practise rooms, or anywhere else in the Studio. Clients acknowledge that no portion of any fees paid by them is in consideration for the safeguarding of valuables.

ARTICLE 10 – Personal Data and Privacy Policy

10.1 Each Guest is aware that they provide certain personal data to Studio 191, such as name, age, address, and email address etc. The personal data of the Guests are strictly confidential and used solely for administrative purposes of Studio 191.

10.2 If the Guest agrees to these Guest Terms and Conditions, the Guest gives Studio 191 permission to process their personal data for commercial purposes of Studio 191. Any processing of personal data by Studio 191 is done in accordance with the Personal Data Protection Act (Wbp). Studio 191 will destroy all Guest data upon the Guest’s written request.

10.3 Studio 191 may take photos or videos of the classes or other spaces in the studio for use on social media or Studio 191’s website. The Guest is aware of this and grants info@Studio 191.nl their permission for this.

10.4 By agreeing to these Guest Terms and Conditions, the Guest unambiguously gives Studio 191 permission to send offers to the Guest via email and other means.

Article 11 – Complaints

11.1 A Guest must report a complaint regarding any performance of Studio 191, teachers or hosting team as soon as possible after the defect or damage has been observed, and no later than fourteen (14) days after the Guest has observed the defects or damage. The complaint is submitted via email to Studio 191 via hello@studio191.nl, stating the location and a description of the complaint.

11.2 The complaint must be complete, clearly described, and accompanied by any necessary or pertinent evidence.

11.3 Studio 191 will respond to the complaint submitted by the Guest as soon as possible, but no later than four (4) weeks from the date of receipt. If Studio 191 expects to need more time to process the complaint, it will immediately notify the Guest of this by email after such discovery.

11.4 If the complaint cannot be resolved through mutual agreement, a dispute as referred to in Article 13.4 of these Guest Terms and Conditions arises.

Article 12 – Website and Mobile App

12.1 The information provided on the website is intended solely for general informational purposes. Due to external circumstances, there may be delays, defects, and/or other imperfections in the provided information.

12.2 Although Studio 191 exercises the utmost care and pride in the composition and maintenance of its website, Studio 191 cannot guarantee that the provided information is complete, up-to-date, and/or accurate. Therefore, the Guest hereby unconditionally and irrevocably waives their right to compensation for any direct or indirect damage that has arisen, arises, or will arise from the use of the personal data unless there is intent or gross negligence on the part of Studio 191.

12.3 The websites of third parties to which (hyper)links are included on the website are not controlled, created, and/or maintained by Studio 191. Therefore, Studio 191 accepts no liability for the content of these linked websites.

12.4 The website and its content are protected by copyright, trademark, and other intellectual property rights. Nothing from this website or its content may be reproduced, stored in an automated data file, or made public in any form or manner, either electronically or mechanically, through photocopies, recordings, or any other means, without prior permission from Studio 191.

Article 13 – Applicable Law

13.1 These Guest Terms and Conditions are effective from 10 December 2015,  and may be changed or updated.

13.2 Deviations from these Guest Terms and Conditions are only valid if confirmed in writing by Studio 191.

13.3 In the event that any provision in these Guest Terms and Conditions is declared void or is nullified, this shall not affect the validity of the remaining provisions. Studio 191 and the Guest shall then enter into consultations to agree on new provisions to replace the void or nullified provisions, while preserving the purpose and scope of the original provision as much as possible.

13.4 Any legal relationship with Studio 191 is governed by Dutch law. All disputes between the Guest and Studio 191 arising from or in connection with the Agreement shall be exclusively settled by the competent court in the district of Amsterdam.

Article 14 – Required Equipment

14.1 Guest safety and physical well-being is of primary importance to Studio 191. To participate in any Reformer class, it is mandatory for all guests to wear grip socks. Studio 191 reserves the right to refuse entry into the class if a member chooses not to wear grip socks. The guest will not be refunded for the class in such circumstances. If attending a Reformer class, Grip Socks are required for safety & hygiene reasons. A guest may bring their own grip socks or they may purchase Studio 191 grip socks from the reception desk or via the Webshop in their Bsport account.

Privacy Statement

Studio 191 is responsible for the processing of personal data as shown in this privacy statement. 

Studio 191 takes your privacy very seriously. We, therefore, treat your personal data with the utmost care and do our very best to secure it.

According to laws and regulations (GDPR)

In all cases, we comply with the requirements set by the European Data Protection Regulation General Data Protection Regulation (GDPR)

Personal data that we process

Here is an overview of the personal data that we could process (but don’t perse require) via the website, mobile app or in general: first name, last name, sex, date of birth, address, telephone number, e-mail address, location data, IP address, other personal data that you actively provide, for example by creating a profile on this website, in correspondence and by telephone, information about your activities on our website, internet browser and device type, and data about your surfing behaviour (because this company is part of an advertising network). 

How long we store personal data
Studio 191 only stores your personal data for as long as is necessary to provide the services of Studio 191 to you. This is also the case for everyone with whom we share your information and who performs services on our behalf. In essence, when you no longer use the Studio 191 services or you no longer wish to receive the Studio 191 newsletter, we will delete your personal data from our systems.

Sharing personal data with third parties
Studio 191 shares your personal data with third parties only if this is necessary for the execution of the agreement and to comply with any legal obligation. With companies that process your data in our assignment, we conclude a processor agreement to ensure the same level of security and confidentiality of your data. Studio 191 remains responsible for these processing operations.

Companies with which we have a processor agreement: BSport. Furthermore, we will never provide the information you provide to other parties.

Personal data responsibility
If a person uses the Website and/or Application, they are responsible for maintaining the confidentiality of their account, and password, and for restricting access to their computer or device. The user agrees to accept responsibility for all activities that occur under their account and/or password.

Provided user information
Studio 191 may use the information provided to contact a member with important information, required notices, and marketing promotions.

How Information is Used

The following are examples of how Studio 191 might use personal information collected through the Website:

– If a member purchases  class credits, signs up for a Studio 191 class, or purchases Studio 191 retail items, the required personal information will be used to complete the order.

– If a member indicates that they are interested in receiving Studio 191 related news and information, they may receive emails to the email address provided as part of the registration process.

– For the non-personally identifiable information collected throughout the Website and Application: aggregate data could be analysed to describe the collective characteristics and behaviours of online visitors, and subsequently be used to further optimise the effectiveness of the Website, Application and the overall Studio 191 experience.

Members can help Studio 191 maintain the accuracy of personal information by updating their account. Please update this information when changes occur in home address, phone number, or email address. 

Studio 191 will never share telephone numbers, email addresses, or any personal data with third parties.

Studio 191 reserves the right to refuse service, terminate accounts, remove or edit content, and cancel orders, at its sole discretion.

Privacy of Minors
If a member is under 18, they may register and use the Website and Application only with the involvement of a parent or guardian. Studio 191 does not accept online registration of minors; members below the age of 16 should not attempt to register on the Website.

If Studio 191 discovers that personal information has been submitted by a minor without a signed Guest/registration waiver, Studio 191 reserves the right to delete such information and terminate access to its facilities. Studio 191 does not seek or share personal information from minors throughout the Website and/or Application.

Cookies, or similar techniques, that we use
Studio 191 uses functional, analytical and third party cookies. A cookie is a small text file that is stored in the browser of your computer, tablet or smartphone when you first visit this website.

Studio 191 uses cookies with purely technical functionality. These ensure that the website works properly and that, for example, your preferred settings are remembered.
